Terms of Use and Data License
VISION
Welcome to the Blue Brain Project (“BBP/EPFL”) Channelpedia, information management framework for comprehensive ion channel information (“Channelpedia”).
Channelpedia is a knowledge-based system centered on genetically expressed ion channel models, which builds an ion channel knowledge base by accommodating both structured and unstructured data (collectively “Channelpedia Data and Models”)
BBP/EPFL is committed to ensure that the outputs of its research are managed and used in ways that maximize public benefit. Making Channelpedia Data and Models widely available to the research community in a timely and responsible manner ensures that they can be verified, built upon and used to advance knowledge and generate improvements.
By accessing and using Channelpedia, you agree to the following terms and conditions of use (“Terms”) and to any future revisions. We may change, suspend, discontinue, limit or remove any part of Channelpedia at any time, without prior notice or liability. Your continued use of Channelpedia following any changes is an agreement by you to the change in Terms. If you do not agree with any of these Terms, please do not use Channelpedia.
LICENSE
Subject to the Citation section below, under these Terms BBP/EPFL grants you a world-wide, non-commercial, non-exclusive, non-sublicensable, royalty-free, revocable license on the Data and Models to (collectively “License”):
i) use, copy, distribute, publicly perform, publicly display, republish the Data and Models for research or other non-commercial purposes only;
ii) create derivative work and/or improvements for research or other non-commercial purposes only.
Non-commercial purpose means: purpose not primarily intended for or directed towards sale, commercial advantage or monetary compensation. Use of Data and Models for research and academic publication, in scholarly journal, textbook or other professional, academic or journalist publications (with appropriate Citation) is not considered commercial use.

Except for the limited permissions expressly stated in these Terms, all rights not specifically granted in these Terms are reserved. BBP/EPFL shall remain the sole owner of all and any intellectual property rights on Data and Models. Additionally, BBP/EPFL retain its rights, title and interest in any Data and Models that is part of, or it is used by you to create improvements and/or derivative works.
If you develop an improvement and/or derivative works based on or utilizing the Data and Models, and you obtain any proprietary rights in or to that improvement and/or derivative works, you and your successors or assigns agree that you will not assert any claim for infringement against the BBP/EPLF for our use of any improvement and/or derivative works that was independently developed by or on behalf of BBP/EPFL.
These Terms prohibit you to offer or impose any additional or different terms, conditions or purposes on improvements and/or derivative works if doing so restricts exercise of the Data and Models by BBP/EPFL and any recipient of the Data and Models.
You may not post any Data and Models on social media or other third-party websites that require you to acknowledge that you own the data you post.
CITATION
While BBP/EPFL is committed to ensure that its Data and Models are used in ways that maximize public benefit, in all cases where Data and Models are used publicly BBP/EPFL requests to give appropriate credit attribution to the original authors and Channelpedia with the following citation (“Citation”).

CONTRIBUTIONS
If you contribute to Channelpedia with text and/or data, models, images created by you (collectively “Contribution”), you thereby irrevocably license to BBP/EPFL your Contribution for reuse and redistribution under the same terms and conditions of the License.
You retain copyright to your Contribution; you can later reuse, republish and relicense it in any way you like. However, you can never retract or alter the license for copies of materials that you place in Channelpedia.
Using copyrighted works from third parties: if your Contribution contains copyrighted works from third parties and/or you have co-authored the Contribution with others, it is your responsibility to acquire the licenses, to follow any citation instructions requested by third-party rights holders, and cover any costs. In addition, it is your responsibility to make sure that copyrighted work from third parties is made available on Channelpedia under terms that are compatible with the License.
HYPERLINK
Some links furnished on Channelpedia may allow you to leave Channelpedia. If you choose to use a third-party website, you will be subject to the terms and conditions of use that apply to such third-party website. These third-party websites are not under our control and we disclaim any responsibility for the contents of such linked websites or any link(s) contained in any such linked website(s) or any changes or updates to any of these websites. We further disclaim any responsibility for any form of transmission received from any linked third-party website or advertising.
If you would like to link to Channelpedia, you may only do so on the basis that you link to, but do not replicate, any page of Channelpedia and subject to the following conditions:
(a) you do not in any way imply that we are endorsing any services or products unless this has been specifically previously agreed with BBP/EPFL in writing;
(b) you do not misrepresent your relationship with us or present any false information about us;
(c) your website does not contain content that is offensive, controversial, or infringes any intellectual property rights or other rights of any other person or entity.
If you choose to link Channelpedia in breach of this section, you shall fully indemnify us for any loss or damage suffered as a result of your actions.
BBP/EPFL LOGO
The BBP/EPFL logo may not be used for any purpose without explicit permission. Inappropriate and/or unauthorized use of logos can lead to legal action.
DISCLAIMER
Data and Models on Channelpedia are provided by BBP/EPFL as-is and as-available, and BBP/EPFL makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability, non-infringement, fitness for a particular purpose, absence of latent of other defects of the Data and Models. Any reliance you place on Data and Models is therefore strictly at your own risk.
You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content or other material obtained from the Resources.
LIMITATION OF LIABILITY
You assume all responsibility for any use of the Data and Models offered on the Channelpedia website. In no event shall BBP/EPFL, its directors, officers, employees, agents, licensees, licensors, contributors, founders or advisors, or any other person who has been involved in the creation or production of Channelpedia or Data and Models be liable for any direct, indirect, special, incidental, or consequential damages, lost profits, lost sales, or loss of goodwill, loss of business, loss of data arising out of the use of, the inability to use, or errors, omissions, interruptions or other inaccuracies in Channelpedia, even if the party had been advised of the possibility of such damages.
GOVERNING LAW
The laws of Switzerland govern these Terms. The exclusive place of jurisdiction shall be Lausanne, Switzerland.
TERMINATION
We may suspend or terminate your access to the Data and Models at any time, without notice, and for any reason. If you fail to comply with these Terms, you no longer have authorization to use the Data and Models, and Channelpedia, and any and all rights granted to you under the Terms are revoked. Your obligations under these Terms will continue upon termination of your rights.
